By posting, listing, uploading, or submitting any property details on HotPropertyBazaar.com, including properties offered for sale, purchase, rent, lease, or Paying Guest (PG) accommodation, you agree to the terms of this Property Posting Disclaimer & Terms of Use.

1. Property Poster’s Responsibility

The person or entity posting a property (“Property Poster”) is solely responsible for ensuring that all information provided in the listing is true, accurate, complete, current, and legally authorized for publication. This includes property ownership details, location, area, price, rent, photographs, amenities, approvals, possession status, RERA information, and any other representation made in connection with the property.

The Property Poster must have the legal right, ownership, authorization, or permission necessary to advertise the property. HotPropertyBazaar does not permit knowingly false, misleading, fraudulent, unauthorized, or unlawful property listings.

2. Platform Role & No Guarantee

HPB Realty Private Limited, operating HotPropertyBazaar.com, provides an online platform for users to publish and discover property-related information. Unless expressly stated otherwise, HotPropertyBazaar is not a party to the underlying sale, purchase, rental, lease, PG, or other transaction between the Property Poster and the prospective buyer, tenant, lessee, or other user.

HotPropertyBazaar does not independently guarantee or certify the ownership, title, legality, approvals, encumbrances, property condition, valuation, availability, RERA status, or authenticity of third-party property listings unless a particular verification service is expressly offered and identified as such.

Publication of a listing does not constitute an endorsement, recommendation, certification, or guarantee by HotPropertyBazaar.

3. RERA & Legal Compliance

Where applicable, Property Posters, builders, developers, promoters, agents, and brokers are responsible for complying with the Real Estate (Regulation and Development) Act, 2016 (RERA) and all applicable State or Union Territory rules, regulations, and requirements.

Property Posters must provide accurate RERA registration details wherever required and must not make false or misleading claims regarding RERA registration, approvals, possession dates, project specifications, amenities, pricing, carpet area, or other material information.

The Property Poster is also responsible for complying with all other laws and regulatory requirements applicable to the property and transaction.

4. Buyer & Tenant Due Diligence

All buyers, tenants, lessees, PG occupants, investors, and other users are strongly advised to conduct independent due diligence before making any payment or entering into any legal or financial commitment.

Before paying token money, booking amounts, advance payments, rent, security deposits, or any other amount, users should independently verify the identity and authority of the advertiser, ownership and title documents, encumbrances, approvals, RERA registration where applicable, property measurements, possession status, and other relevant information.

Users are advised to verify documents through appropriate government authorities, RERA authorities, Sub-Registrar or revenue offices, municipal authorities, and qualified legal professionals, as applicable. Physical inspection of the property is also strongly recommended.

5. Fraudulent & Prohibited Listings

Listings involving fake properties, impersonation, forged documents, false ownership claims, fake RERA information, fraudulent payment requests, fake booking or token arrangements, misleading investment claims, phishing, or other unlawful activities are strictly prohibited.

HotPropertyBazaar may review, restrict, suspend, or remove any listing or account where it reasonably believes that the content is fraudulent, misleading, unlawful, unauthorized, or otherwise violates this Policy or applicable law.

6. Limitation of Liability

To the maximum extent permitted by applicable law, HPB Realty Private Limited and HotPropertyBazaar shall not be responsible for losses, disputes, claims, damages, or expenses arising from inaccurate, false, misleading, unauthorized, fraudulent, or unlawful information supplied by a Property Poster or from transactions independently entered into between users and Property Posters.

HotPropertyBazaar does not guarantee the performance, conduct, payment, delivery, possession, title, or contractual obligations of any buyer, seller, landlord, tenant, developer, builder, broker, agent, or other party.

Nothing in this Policy is intended to exclude or limit any liability, statutory right, consumer protection, or legal remedy that cannot lawfully be excluded or limited under applicable Indian law.

7. Indemnification

To the maximum extent permitted by applicable law, the Property Poster agrees to indemnify and hold harmless HPB Realty Private Limited, HotPropertyBazaar, its directors, officers, employees, agents, affiliates, and service providers against claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from the Property Poster’s false or misleading information, unauthorized listing, fraud, negligence, infringement of third-party rights, violation of applicable law, or breach of this Policy.

8. Copyright & Listing Content

The Property Poster must have the necessary rights or permission to use photographs, videos, floor plans, descriptions, logos, documents, and other content uploaded to HotPropertyBazaar.

Content that infringes copyright, trademark, privacy, or other third-party rights may be restricted or removed upon receiving an appropriate complaint or where otherwise required by applicable law.

9. Reporting & Grievance

Users may report suspected fraudulent, misleading, unauthorized, infringing, or unlawful listings through the grievance or reporting mechanism provided by HotPropertyBazaar.

Where possible, complaints should include the property listing URL or ID and relevant supporting information so that the matter can be reviewed efficiently.

10. Changes & Enforcement

HotPropertyBazaar reserves the right, subject to applicable law, to review, modify, restrict, suspend, archive, or remove listings and accounts that violate this Policy, the Terms & Conditions, or applicable Indian laws.

This Policy may be updated from time to time to reflect changes in applicable laws, regulations, platform services, or security requirements.

By posting a property on HotPropertyBazaar.com, you acknowledge that you are responsible for your listing, representations, content, and conduct and agree to comply with this Policy and all applicable laws in India.
