We maintain "Safe Harbor" protection under Section 79 of the IT Act and comply with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2. Mandatory Indian Legal & Regulatory Compliance

All advertisers, property owners, builders, developers, and real estate agents utilizing our website and mobile applications must strictly adhere to the regulatory frameworks enforced by Indian governmental and statutory authorities:

Real Estate (Regulation and Development) Act, 2016 (RERA) & State Authorities:

Builders and real estate agents advertising projects governed by RERA must explicitly display their valid State-specific RERA Registration Number in the designated fields.

The Platform aligns its operations with statutory bodies such as the State Real Estate Regulatory Authorities (e.g., MahaRERA, UP-RERA, TNRERA, etc.) and the

Central Advisory Council established under Section 41 of the RERA Act to monitor sector transparency.

Local Municipal & Urban Development Authorities:

Advertisers must ensure that properties listed comply with local municipal corporations, urban development authorities (e.g., DDA, CIDCO, HUDA/HSVP, BDA etc), and town planning laws.

Listings must possess requisite local land-use permissions, sanctioned building plans, and statutory occupancy/completion certificates where applicable.

Consumer Protection Act, 2019 & E-Commerce Rules, 2020: Listings must not contain misleading descriptions, hidden charges, or deceptive pricing baits. Advertisers are legally liable for any false trade practices.

The Digital Personal Data Protection (DPDP) Act, 2023: Users uploading data or client information via the website or mobile apps must ensure full compliance with statutory privacy rights and consent mandates.

3. Prohibited Content & Listing Guidelines

To maintain a safe and transparent marketplace across our website and mobile applications, the following content types are strictly prohibited:

Fraudulent or Unregistered RERA Listings: Posting commercial or residential projects that fail to provide mandatory RERA registration numbers or display false/revoked registration details.

Brokerage & Commission Violations: Since HotPropertyBazaar.com operates on a strict Zero-Brokerage / Zero-Commission Model, listings cannot demand hidden broker fees or unauthorized platform charges.

Copyrighted or Stolen Media: Uploading watermarked photos, floor plans, or graphics without explicit ownership rights or valid written licenses.

Discriminatory Content: Listings that discriminate based on religion, caste, community, gender, marital status, or food habits in violation of public policy.

Offensive or Obscene Material: Vulgar text, explicit imagery, hate speech, or content prohibited under Section 67 of the IT Act, 2000.

4. Intellectual Property & Media Rights

By uploading photos, videos, floor plans, or text ("Content") to our website or mobile apps, you declare that you are the absolute owner or authorized licensee of such content.

You grant HotPropertyBazaar.com a royalty-free, perpetual license to host, display, distribute, and market your uploaded content across our digital channels and applications.

Takedown Mechanism: If a copyright or legal infringement is reported via support@hotpropertybazaar.com, the platform reserves the right to remove the offending content immediately without prior notice.

5. Platform Rights, Enforcement & Indemnification

Right to Modify or Remove: HotPropertyBazaar.com holds the absolute right to pre-screen, edit, restrict, suspend, or permanently ban accounts and listings across its web and mobile interfaces that violate this policy or Indian law.

Cooperation with Law Enforcement: In compliance with IT Rules, we will hand over user registration logs, device IDs, IP addresses, and KYC records to law enforcement agencies, RERA authorities, or judicial bodies upon receiving formal legal requests.

Indemnification: Advertisers agree to fully indemnify and hold harmless HPB Realty Private Limited, its directors, and employees from any legal claims, lawsuits, RERA penalties, consumer disputes, or financial losses arising from their property listings.

Cautionary Note to Buyers and Tenants: HotPropertyBazaar.com does not physically inspect properties or verify title deeds. All users are advised to cross-verify project details directly on official State RERA Portals and conduct independent due diligence before transferring token money or signing agreements.
