Strict Personal Accountability: You explicitly understand and agree that HotPropertyBazaar.com does not actively verify, audit, or authenticate ownership, originality, or licensing of any user-uploaded media. Absolute Indemnity & Third-Party Claims: If any copyright infringement claim, legal demand, structural dispute, trademark litigation, takedown request, regulatory notice, or lawsuit arises relating to Content that you uploaded, you accept complete, unconditional, and exclusive liability for such claims. HotPropertyBazaar.com and its parent entity, HPB Realty Private Limited, shall bear zero civil or criminal responsibility for such disputes.

Irrevocable Platform Media License:By continuing to upload media, you grant HotPropertyBazaar.com a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to store, host, publish, reproduce, display, crop, distribute, format, or process your uploaded Content for the explicit purposes of property listing publication, platform optimization, marketing, search engine visibility, and native brand functionality.

3. Right to Moderate, Restrict, and Terminate

HotPropertyBazaar.com acts strictly as a passive digital intermediary. To maintain marketplace integrity and ensure statutory compliance under the

Information Technology Rules, 2021, the platform reserves the absolute right, at its sole discretion, to:

• Remove, disable access to, or permanently delete any Content without prior notice if it is suspected of infringement.
• Suspend, restrict, or permanently terminate your user account and blackhole your IP address.
• Block future property postings or listing activations linked to your profile.
• Fully cooperate with law enforcement agencies, cyber cells, and statutory copyright authorities, which includes sharing your registered phone number, email, IP logs, and KYC data if required by legal process.

4. Comprehensive Indemnification Clause

You agree to fully indemnify, defend, and hold harmless HotPropertyBazaar.com, its parent company, directors, promoters, employees, affiliates, tech partners, and legal advisors from and against:

• Any and all third-party copyright, trademark, or intellectual property claims.
• Legal expenses, advocate fees, court costs, arbitration costs, and administrative disbursements.
• Statutory penalties, fines, municipal or regulatory compliance updates, and civil damages.
• Direct or indirect commercial losses arising out of, or connected to, the unauthorized or infringing Content uploaded by you.

5. Civil and Criminal Legal Consequences

You acknowledge that uploading stolen, watermarked, altered, misleading, or AI-generated media without valid commercial licensing constitutes a punishable offense under Indian law. Under Section 63 and 63A of the Indian Copyright Act, 1957, intentional copyright infringement is a cognizable and non-bailable offense that carries a penalty of imprisonment ranging from 6 months to 3 years, along with a fine of up to ₹2,00,000. Furthermore, fraudulent misrepresentation on electronic systems attracts strict prosecution under the Information Technology Act, 2000.

6. Intermediary Status & Statutory Takedown Policy (Safe Harbor)

HotPropertyBazaar.com claims absolute statutory immunity ("Safe Harbor Protection") under Section 79 of the Information Technology Act, 2000 and Section 52(1)(c) of the Indian Copyright Act, 1957. We do not initiate the transmission, select the receiver, or modify the user-generated information contained within media uploads.

Notice of Infringement (Takedown Workflow)

If you are a rightful copyright holder or an authorized agent and believe that a listing on our platform features media that violates your intellectual property, please submit a formal written complaint to our Grievance Officer at grievance@hotpropertybazaar.com containing:

1. Clear identification of the copyrighted work claimed to have been infringed.
2. The exact URL link(s) or Listing ID(s) of the allegedly infringing material.
3. Your official contact information (Name, Address, Phone, and Email).
4. A statement backed by proof of ownership confirming that the use of the material is unauthorized.

Upon receipt of a valid, verifiable grievance, the platform will process the request and disable access to the infringing material within the statutorily mandated timeframe.
